Introduction
This End User License Agreement, or “EULA,” is a legal agreement between you and Podium Labs LLC, referred to as “Podium,” “we,” “our,” or “us,” for the use of the Podium mobile application, referred to as the “App.”
By downloading, installing, accessing, or using the App, you agree to be bound by this EULA. If you do not agree to this EULA, do not use the App.
License Grant
We grant you a limited, non exclusive, non transferable, revocable license to download, install, and use the App on a device that you own or control, strictly in accordance with this EULA and any applicable terms from the platform through which you obtained the App, including the Apple App Store.
License Restrictions
You agree not to:
Copy, modify, or distribute the App or any portion of it
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
Rent, lease, lend, sell, sublicense, or otherwise transfer the App to any third party
Remove, alter, or obscure any proprietary notices on the App
Use the App for any unlawful, harmful, or unauthorized purpose
Use the App in any way that could interfere with, disrupt, or negatively affect the App or its servers
Use automated scripts, bots, scraping tools, or other automated methods to access or interact with the App
Create fake accounts, impersonate others, or misrepresent your identity
Post or share content that is abusive, threatening, hateful, unsafe, misleading, or otherwise inappropriate
Ownership
The App and all rights, title, and interest in and to the App, including all intellectual property rights, are and will remain the exclusive property of Podium Labs LLC.
This EULA does not grant you any ownership interest in the App. It only grants you a limited right to use the App in accordance with this EULA.
User Content
You retain ownership of the content you submit, create, or share through the App. This may include profile information, photos, routes, event details, messages, comments, and other content you choose to provide.
By using the App, you grant Podium a limited license to use, host, store, process, display, and transmit your content solely as needed to operate, provide, secure, and improve the App.
You are responsible for the content you submit through the App. You agree that you will not submit content that violates any law, infringes on another person’s rights, or creates a safety risk for other users.
Events, Routes, and Community Features
Podium helps users discover, create, join, and share local fitness events, routes, races, clubs, workouts, and active meetups.
You understand that events, routes, and meetups may be created by users or third parties. Podium does not guarantee the accuracy, safety, availability, quality, or suitability of any event, route, meetup, club, location, or user generated content.
You are responsible for using your own judgment before attending an event, meeting another user, following a route, or participating in any activity found through the App.
Safety and Fitness Disclaimer
Podium is not a medical device and does not provide medical advice.
Fitness activities, events, routes, and meetups may involve risks, including injury, accidents, traffic hazards, weather conditions, unsafe locations, or other dangers. You are responsible for evaluating your own health, fitness level, surroundings, and ability before participating in any activity.
You should consult a qualified healthcare professional before starting any new exercise program or participating in strenuous physical activity.
You use the App and participate in any related activities at your own risk.
Third Party Services
The App may use third party services to support core functionality, such as authentication, data storage, analytics, crash reporting, maps, payments, subscriptions, app distribution, and other app operations.
Your use of third party services may be subject to their own terms and privacy policies. We are not responsible for the content, availability, privacy practices, or terms of third party services.
Subscriptions and Payments
Podium may offer paid features, subscriptions, or premium access through the App.
If you purchase a subscription or paid feature, your payment will be processed through the platform where you obtained the App, such as Apple. Subscription terms, renewals, cancellations, refunds, and billing are managed by the applicable platform and subject to that platform’s terms.
You are responsible for managing or canceling your subscription through your App Store account settings.
Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON INFRINGEMENT, AND AVAILABILITY.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR FREE, SECURE, ACCURATE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PODIUM LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP.
THIS INCLUDES DAMAGES RELATED TO EVENTS, ROUTES, MEETUPS, USER INTERACTIONS, THIRD PARTY SERVICES, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Termination
This EULA is effective until terminated.
We may suspend or terminate your access to the App at any time if you violate this EULA, misuse the App, create safety concerns, or engage in conduct that may harm Podium, other users, or the App.
Upon termination, you must stop using the App and delete all copies from your devices. Sections related to ownership, user content, disclaimers, limitation of liability, and governing law shall survive termination.
Updates and Modifications
We may update, modify, or improve the App from time to time. Updates may be required for you to continue using the App.
We may also update this EULA from time to time. Your continued use of the App after changes are posted means you accept the updated EULA.
Governing Law
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which Podium Labs LLC operates, without regard to its conflict of law provisions.
